504: Performance and Payment Bonds
A performance bond is required for all construction contracts
that exceed $25,000 in value, in the amount of 100% of the
contract price. The performance bond shall be delivered to
the District at the same time the contract is executed. If
a contractor fails to deliver the performance bond, the contractor's
bid shall be rejected, it's bid security shall be enforced,
and award of the contract shall be made to the next lowest
responsible and responsive bidder.
A performance bond protects the District against loss resulting
from the failure of the contractor to perform a construction
contract in accordance with plans and specifications.
A payment bond is required for all construction contracts
that exceed $25,000 in value, in the amount of 100% of the
contract price. The payment bond shall be delivered to the
District at the same time the contract is executed. If a contractor
fails to deliver the payment bond, the contractor's bid shall
be rejected, it's bid security shall be enforced, and award
of the contract shall be made to the next lowest responsible
and responsive bidder.
A payment bond guarantees payment and protection for those
furnishing labor and materials to the contractor or its subcontractors
for the work bonded.
