Blended Overtime (OT) Rates for Non-Exempt Employees Serving in Certified Teaching Capacity

The US Department of Labor has rendered an interpretation of one of the FSLA provisions that impact educational institutions.Classified (Non-Exempt) employees who serve in a certified/teaching capacity in addition to their regular forty (40) hour assignment must be paid a blended overtime rate. Overtime Payment for Non-Exempt Employees Working in Two Different Positions

To comply with the FLSA (Fair Labor Standards Act), please review the following information to determine whether or not the persons you employ, who work in multiple jobs, are entitled to overtime payment. This applies to non-exempt staff, temporaries and student workers.
