The Affordable Care Act

In March 2010, President Barack Obama signed The Affordable Care Act (ACA) into law. This legislation ensures that Americans have access to affordable medical insurance. The law requires employers that have 50 or more full-time employees to offer medical insurance to full-time employees and their children up to age 26.

On July 2, 2013, the U.S. Department of the Treasury delayed the ACA’s employer shared responsibility penalty and reporting requirements until 2015. On July 1, 2015, the start of Maricopa County Community College District’s fiscal year, we must be in full compliance with the ACA. Because we will use a 1 year look back period, MCCCD must comply with its limitations and rules regarding part-time/part-time employees starting July 1, 2014.

The information below explains how MCCCD will manage part-time staff and adjunct faculty hours moving forward. We will update this information as necessary.

Employment Classification Table

Employment Classification Maximum Hours Worked Time/Location for Determination
Part-time Employees (RPS/contract) No more than 25 per week, except during per-determined peak season weeks. 40 hours is allowed during peak weeks. Employees are limited to a maximum of 25 hours per week. During defined MCCCD peak periods part-time part-time employees may be permitted to work up to 40 hours per week, but this is only for a defined seasonal peak periods and employees are limited to a maximum of 25 hours per week in all other weeks. Employees can work at more than one college/department, however they are limited to a total of 25 hours per week among all assignments.
Adjunct Faculty - Instructional

No more than 9 load hours per term, with limited exceptions of up to an additional 3.0 load hours for 12 maximum load hours during Spring/Fall terms and 11 hours for the Summer term..

This load can be taught over any number of weeks in the fall or spring term. If the 9 load is taught in less time than the full semester, the adjunct cannot teach or work any other hours during the term. The adjunct could work up to 25 part-time hours during weeks which fall outside of the term. Employees can work at more than one college/department.
Adjunct Faculty - Service No more than 25 clock hours per week. Limits apply in each and every week of the year. Employees can work at more than one college/department.
Combination - Adjunct/Part-time No more than 25 total hours worked per week. Load hours are converted to work hours by multiplying load X 2. This amount is subtracted from 25. Any remaining hours can be worked as service faculty or in a part-time capacity.

Please note that if an employee serves as an adjunct faculty and also works other part-time hours, that employee is limited to the 25 hours per week total including district-defined "peak weeks".
