Group Legal Plan for Members for the MCCD District Faculty Association

On behalf of the Maricopa Community Colleges District Faculty Association, the Maricopa Community Colleges Faculty Executive Council agrees to enter into contract with Mike Napier for the following legal services:

1.   Unlimited representation at an administrative level for Faculty Association members, who

have been referred by the Faculty Executive Committee, on matters pertaining to their employment.  Unlimited representation for the Faculty Executive Council on matters pertaining to the faculty issues.  This will include but is not restricted to grievances, RFP interpretations, and consultations.  The representation does NOT include any litigation that might result from the issues being represented.

2.   For personal matters, MCCD faculty, who are members of the Faculty Association, will

receive legal representation at the costs listed below:

                             Domestic Relations  $175.00/hour

                             Probate   $175.00/hour

                             Employment Litigation $175.00/hour

                             Simple Wills   $  75.00

                             Reciprocals   $  75.00

                             Personal Injury  25% contingency on insurance-related matters

                             All other matters  $175.00/hour

In return for the above services, the Faculty Executive Council will pay Michael Napier $3.00 per month per Faculty Association member, the money to be paid on a quarterly basis beginning July 1, 2007.

Mike Napier may terminate this contract after a period of one year with a thirty day written notice.  The Maricopa Faculty Executive Council may terminate the contract after 180 days with a thirty day written notice.

If the contract is terminated within the first year, the Faculty Executive Council will revert to its original contract previously in place with Mike Napier, i.e. an hourly consultation fee of $110.00 per hour for Faculty Association members referred by the Faculty Executive Committee.
